1. Agreement to These Terms
These Terms of Service (“Terms”) govern your access to and use of lphlab.com (the “Site”) and any purchase you make through it. The Site is owned and operated by ONEVERT LLC, a California limited liability company (“Onevert,” “LPH LAB,” “we,” “us,” or “our”).
By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
2. Who May Use the Site
You must be at least 18 years old, or the age of majority where you live, to place an order. By placing an order you represent that you meet this requirement and that the information you provide is accurate and complete.
3. Our Products
LPH LAB products are cosmetic and personal care products. They are not drugs and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Nothing on the Site is medical advice.
Individual results vary. We recommend performing a patch test before first use and discontinuing use if irritation occurs. If you are pregnant, nursing, taking medication, or have a known skin condition or allergy, consult a qualified healthcare professional before use.
Product images are for illustration. Packaging, formulation, and ingredient listings may be updated from time to time; the label on the product you receive is the authoritative source for ingredients and directions for use.
4. Where We Ship
We currently sell and ship only within the United States. We do not accept orders for delivery outside the United States.
5. Orders and Acceptance
Your order is an offer to buy. We accept your offer when we send an order confirmation or ship the items, whichever comes first. We may decline or cancel any order — including after confirmation — for reasons including product unavailability, errors in pricing or product information, suspected fraud, or an order that appears to be placed for resale. If we cancel an order you have already paid for, we will refund you in full.
We reserve the right to limit order quantities per person, per household, or per order.
6. Pricing and Payment
All prices are shown in U.S. dollars. Prices and promotions may change at any time before you place an order. Where we are required to collect sales tax, it is calculated and shown at checkout before you complete your order.
Payments are processed by third-party payment processors. By submitting payment information, you authorize us and our processors to charge the applicable amount, and you confirm that you are authorized to use the payment method. We do not store full payment card numbers on our servers. See our Privacy Policy for how payment information is handled.
If we discover a pricing or description error after you place an order, we may cancel the order and refund you in full, or contact you to confirm whether you wish to proceed at the corrected price.
7. Shipping and Delivery
Shipping methods, handling times, and delivery estimates are set out in our Shipping Policy, which forms part of these Terms. Delivery estimates are estimates only and are not guaranteed.
We bear the risk of loss and damage until your order is delivered to the address you provide. If your order does not arrive, or arrives damaged, contact us at info@lphlab.com and we will replace it or refund you.
8. Returns and Refunds
Returns and refunds are governed by our Returns and Refund Policy, which forms part of these Terms. Note in particular that, as stated in that policy, personal care and beauty products are generally non-returnable once opened, for hygiene reasons.
9. Intellectual Property
The Site and its contents — including text, images, logos, product names, and the LPH LAB brand — are owned by ONEVERT LLC or its licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive licence to view the Site for personal, non-commercial use. You may not copy, reproduce, scrape, or use our content or trademarks without our prior written permission.
10. User Accounts
If you create an account, you are responsible for keeping your credentials confidential and for all activity under your account. Notify us promptly at info@lphlab.com if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.
11. Reviews and Submissions
If you submit a review, photograph, comment, or other content, you grant us a non-exclusive, irrevocable, royalty-free, worldwide, perpetual licence to use, reproduce, and display it in connection with our business, including in marketing. You represent that the content is your own, is accurate, and does not infringe anyone’s rights. We may remove any submission at our discretion. We do not condition, edit, or suppress reviews based on whether they are positive.
12. Prohibited Conduct
You agree not to use the Site to break any law; to infringe our or a third party’s rights; to transmit malware; to scrape, crawl, or harvest data by automated means; to interfere with the Site’s operation or security; or to place fraudulent orders.
13. Disclaimers
Except as expressly stated in these Terms and to the fullest extent permitted by law, the Site is provided “as is” and “as available,” and we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement in respect of the Site. We do not warrant that the Site will be uninterrupted or error-free.
Some jurisdictions do not allow the exclusion of implied warranties or limitations on how long an implied warranty lasts, so the exclusions above may not apply to you. Nothing in these Terms excludes or limits any right or remedy you have that cannot be excluded or limited under applicable law, including under the California Consumer Legal Remedies Act and the Song-Beverly Consumer Warranty Act.
14. Limitation of Liability
To the fullest extent permitted by law, and except as set out in the paragraph below, ONEVERT LLC and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Site.
This section does not limit or exclude our liability for death or personal injury, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, for product liability, or for any other liability that cannot be limited or excluded under applicable law.
15. Indemnification
You agree to indemnify and hold harmless ONEVERT LLC from any third-party claim, loss, liability, or expense (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.
16. Electronic Communications
By using the Site or placing an order, you consent to receive communications from us electronically — including order confirmations, shipping notices, and legal notices relating to your purchase — at the email address you provide, and you agree that such electronic communications satisfy any legal requirement that a communication be in writing. Marketing emails are separate and you may unsubscribe from them at any time using the link in each message.
17. Force Majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, epidemics, war, civil unrest, labour disputes, carrier delays, utility or telecommunications failures, or governmental action.
18. Assignment
You may not assign or transfer these Terms. We may assign or transfer these Terms, in whole or in part, to an affiliate or in connection with a merger, reorganisation, or sale of all or part of our business or assets.
19. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or your purchase will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you and we consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from bringing an individual claim in small claims court.
20. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date above reflects the most recent version. The version of these Terms in effect at the time you place an order governs that order. Where we make a material change, we will take reasonable steps to notify you, such as by posting a notice on the Site or emailing account holders.
21. Severability and Entire Agreement
If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions stay in full effect. These Terms, together with our Privacy Policy, Shipping Policy, and Returns and Refund Policy, are the entire agreement between you and us regarding the Site.
